2.1 Acceptance of the Terms of Use
Any connection to the Sites and Applications of TAHITI NUI TELEVISION, as well as the consultation and use of their Content, is carried out within the framework of these TOU, which are intended to define the terms and conditions for the use of the Services and Content offered.
Access to any of the Sites and Applications of TAHITI NUI TELEVISION automatically implies the full application and unconditional acceptance of the rules and conditions defined in these TOU. If a User refuses to adhere to these TOU, they must refrain from accessing the Sites and Applications of TAHITI NUI TELEVISION.
The applicable TOU are those in effect at the date of each connection of the User to the Sites and Applications. TAHITI NUI TELEVISION may update or modify the TOU at any time. These modifications are made known to Users simply by being posted online. Consequently, they are deemed to be accepted without reservation by any User accessing the Sites and Applications after their publication. Users are therefore invited to consult them at each visit to review the latest version available.
2.2 Specific Terms
2.2.1 Access to Certain Services
Access to certain services on and/or through the Sites and Applications may be subject to the acceptance of specific terms of use and/or sale, which any User wishing to access such services must accept.
The « pay-per-view » service, available only on the TAHITI NUI TELEVISION website, allows live streaming of various events, provided the User has created a personal account on the TAHITI NUI TELEVISION website.
The Applications are free, excluding internet subscription costs from the operator and any additional charges billed by the operator through the Applications for data upload and download.
As the use of the applications may involve significant data consumption, particularly video viewing, TAHITI NUI TELEVISION recommends using the Applications with an appropriate data plan (e.g., unlimited) or via Wi-Fi.
In case of conflict between these TOU and the aforementioned specific conditions, the specific conditions shall prevail.
2.2.2 Partner Services
The Sites and Applications also allow access to third-party services, published by partners, through hyperlinks integrated in various sections, directing to the websites, content, and services of such partners. These Partner Services may also be accessible through clickable advertising elements (banners, videos, etc.).
The User acknowledges that these Partner Services are completely independent from TAHITI NUI TELEVISION. Therefore, any use of the Partner Services via the Sites and Applications is subject solely to the terms of use and/or sale defined by each respective Partner.
TAHITI NUI TELEVISION shall not be held responsible for any content accessed, offers, information consulted, or transactions made on the Partner Services. Similarly, TAHITI NUI TELEVISION makes no guarantee as to the compliance of such services with current regulations, which is the sole responsibility of the Partner publishers.

4. Creating a User Account
4.1 Prior Registration
Access to certain Services offered on the TAHITI NUI TELEVISION Sites and Applications, particularly “pay-per-view” services for live events, personalized services such as playback resumption, favorites, editorial content recommendations, push notification customization, and video playback continuity, requires the prior creation of a User Account.
When creating a User Account, the User must choose a personal login—using a valid email address that is not associated with a disposable email service—and a secure password.
Additionally, a registration form will be presented to the User, requiring the submission of certain personal data (either mandatory or optional): username, pseudonym, title, year or date of birth, and postal code. The required data may vary depending on the specific TAHITI NUI TELEVISION Site or Application.
Failure to provide mandatory information will result in the User being unable to validate the creation of their account or access an existing account.
The User also agrees to submit only accurate and up-to-date personal data and to refrain from using pseudonyms or email addresses that may infringe on third-party rights (e.g., registered trademarks, names, pseudonyms, copyrighted works) or compromise security (e.g., temporary/disposable email addresses).
TAHITI NUI TELEVISION reserves the right to reject any registration that does not comply with these conditions.
4.2 Protection of Minors
If the User is a minor at least 16 years of age, they declare and acknowledge that they have obtained prior authorization from their parent(s) or legal guardian(s) to register for services on the Sites. These guardians accept responsibility for ensuring compliance with these TOU by the minor.
Parents or legal guardians are encouraged to monitor the use of Content and Services made available on the Sites and Applications and to remember that it is their legal duty to oversee such use.
Minors under the age of 16 are not permitted to create a User Account.
4.3 Registration Confirmation / Use of Login Credentials
TAHITI NUI TELEVISION will automatically send an email to inform the User of the creation of their account.
TAHITI NUI TELEVISION cannot be held responsible if personal data required for account creation fails to reach them, or arrives partially unreadable due to technical issues caused by the User’s equipment (internet server, hardware, software, etc.).
The User’s login and password are strictly personal and confidential. The User is solely responsible for maintaining their confidentiality and use.
Any connection to the Sites using the account and/or transmission of data through it will be considered as having been made by the account holder, under their full responsibility.
In case of loss or misuse of login credentials, the User must immediately notify TAHITI NUI TELEVISION in writing and change their password.
4.4 Use of Third-Party Log
Access to certain features or community services may require the use of third-party credentials, such as Facebook, X (Twitter), or Google.
The User must log in using their credentials from these networks or create an account on them to use community features that involve interaction with such services.
As stated in section 2.2.2 regarding Partner Services, the creation and use of such accounts are governed solely by the terms and conditions of the respective third-party publishers, excluding all liability of TAHITI NUI TELEVISION.
5. Personal Data
5.1 User Rights
The personal data provided when creating a User Account is collected and processed for the purpose of account creation and management, support via the viewer relations service, delivery of service communications, information on functionalities, marketing communications for similar services, audience measurement, service personalization (user environment, content, communications), and targeted advertising.
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (known as the “GDPR”) and French Law No. 78-17 of January 6, 1978 (known as the “Data Protection Act”), the User has the right to access, rectify, delete, restrict processing, object, and request data portability. Users may also define directives regarding the fate of their personal data after death, within the limits and under the conditions set by applicable laws and jurisprudence.
The User may withdraw their consent at any time regarding future processing based on consent.
The User may exercise their rights in various ways:
- By logging into their User Account and accessing the dedicated account pages
- Via the « Contact Us » page accessible in the footer or in the settings of the Sites and Applications
- By sending an email to: [email protected]
- By mailing a letter to:
DPO – TAHITI NUI TELEVISION

For more details about how personal data is processed, Users are encouraged to consult the privacy policy.
TAHITI NUI TELEVISION emphasizes that according to its privacy policy, the data submitted when creating a User Account is retained in a form enabling identification as long as activity is detected on the account in the previous 24 months. After this period, the account will be closed.
5.2 Trackers (Cookies)
The User is informed that during their visits to the Sites and Applications, trackers (cookies or equivalent) may be deposited and/or read on their device (computer, smartphone, tablet, connected TV, etc.), depending on the operating system or application used—provided the User has given prior consent.

8.2 Intellectual Property Related to User Content on Social Networks

These rights are granted worldwide, for all media and by any distribution process known or unknown at this time.
Users expressly agree that certain content may be reformatted for technical reasons related to permitted usage and therefore grant the necessary adaptation rights.
Users also acknowledge that no exploitation of their content or comments, as authorized under these TOU, shall give rise to any compensation—financial or otherwise.

However, access may be suspended for maintenance or upgrades to ensure the proper operation of the Sites and Applications, without any obligation on TAHITI NUI TELEVISION’s part to inform Users in advance.
TAHITI NUI TELEVISION offers no guarantee concerning potential interruptions or malfunctions resulting from network congestion, system failures, third-party intrusions, or virus contamination through these networks and services.

11.2 Limitation to Direct Damages
In the event that TAHITI NUI TELEVISION is held liable for a breach of its obligations under these Terms of Use, such liability shall be limited strictly to direct, personal, and certain damages, to the exclusion of any indirect or intangible damages (e.g., financial loss, commercial damage, loss of revenue or data).
